• "Service" refers to GTM Alpha consulting services, MCP server, API, and website
• "User", "You" refers to individuals or entities using our Service
• "We", "Us", "Our" refers to Helix GTM Consulting
• "Content" refers to analysis reports, recommendations, and materials provided

2. Services Offered

2.1 GTM Consulting Services

• Premium Audit (free during testing): EPIC framework scores with the rule behind each, recommendations and an implementation roadmap
• MCP Tool Calling (free): Programmatic access to the three GTM Alpha tools
• Consulting: not sold through this website. Any consulting work with Helix GTM Consulting is agreed separately in writing

2.2 MCP Server Access

The GTM Alpha MCP server provides AI assistant integration via Model Context Protocol. Usage is subject to:

• Fair use limitations (reasonable request volume)
• No automated scraping or abuse
• Attribution when sharing analysis results publicly

3. User Obligations

By using our services, you agree to:

• Provide accurate information for consultations
• Use services for lawful business purposes only
• Not attempt to reverse engineer, hack, or disrupt our systems
• Not resell or redistribute our analysis tools without permission
• Respect intellectual property rights

4. Intellectual Property

4.1 Our Content

Helix GTM Consulting retains all rights to:

• EPIC Framework methodology
• Website content, design, and branding
• MCP server software and tools
• Analysis templates and frameworks

4.2 Your Content

You retain ownership of:

• Business information you provide
• Custom analysis reports generated for you

You grant us a limited license to use your information solely for providing services.

5. Payment

Nothing is sold during testing. The Premium Audit and the MCP tools are free, and no payment is taken on this website. Consulting work with Helix GTM Consulting is agreed and invoiced separately in writing.

6. Disclaimers

6.1 No Warranty

Services are provided "AS IS" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy or completeness of analysis
• Uninterrupted or error-free service

6.2 Consulting Nature

Our services are advisory in nature. You are responsible for:

• Evaluating and implementing recommendations
• Business decisions based on our analysis
• Verifying information relevant to your specific context

7. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability shall not exceed the amount you paid for services in the preceding 12 months
• We are not liable for indirect, incidental, special, consequential, or punitive damages

You agree to indemnify and hold harmless Helix GTM Consulting, its affiliates, and Shashwat Ghosh from any claims, damages, or expenses arising from:

We treat your business information as confidential and will not disclose it to third parties except:

• With your consent
• As required by law
• To service providers under confidentiality obligations

10. Termination

• You may stop using our services at any time
• We may terminate or suspend access for violation of these terms
• Upon termination, you retain access to reports already delivered

11. Governing Law

These terms are governed by the laws of India. For international users:

• EU users retain their statutory rights under GDPR
• California users retain their rights under CCPA

Disputes shall be resolved through good-faith negotiation, then arbitration in Mumbai, India if necessary.

If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
